Relating to the powers and duties of the Parks and Wildlife Department regarding wind-powered energy devices; providing a civil penalty.
No significant fiscal implication to the State is anticipated.
HB 783 would allow the Texas Parks and Wildlife Department to designate certain areas in the vicinity of Devils River State Natural Area where wind powered energy devices are prohibited. Under this bill, TPWD may adopt rules for designating locations for the installation of a wind-powered energy devices that must consider protection of natural resources, protection of public health and safety, enjoyment of public lands and other factors.
While this bill appears to be sound public policy, it does not have a clear connection to our liberty principles. Texas Action remains neutral on HB 783.
