Bill Analysis

HB 744 would require law enforcement agencies to submit a written statement when filing a criminal case with a state attorney acknowledging that they have transmitted all items that the state attorney is required by law to disclose to the defendant. If any such item is discovered after the case has been filed, the law enforcement agency would be required to promptly transmit it to the state attorney.

Vote Recommendation Notes

Texas Action supports HB 744 because it would further protect the due process of those charged with a crime. Disclosure requirements on both law enforcement and prosecutors defend the rights of the accused and limit abusive prosecutions. HB 744 would address this problem effectively by requiring full disclosure from the investigating law enforcement agency.
