Bill Analysis

HB 4668 would create the Medina County Water Control and Improvement District No. 4 to undertake duties related to collection, transportation, processing, disposal, and control of domestic, industrial, or communal waste and the gathering, conducting, diverting, and control of local storm water or other harmful excesses of water.

The district would have 5 elected board members. The district would have the power to design, acquire, construct, finance, issue bonds for, improve, operate, maintain, and convey to this state, a county, or a municipality for operation and maintenance macadamized, graveled, or paved roads, or improvements, including storm drainage, in aid of those roads.

The district may only exercise eminent domain within district boundaries for an eligible project if this bill receives two-thirds vote of all the members elected to each house. The district has authority to issue bonds for its projects but requires an election to impose ad valorem or operation and maintenance or contract taxes.
