HB 464 requires food service establishments to display a poster relating to food allergen awareness in an area of the establishment accessible to their employees. The Department of State and Health Services is required to determine the form and content of this poster, post a sample on their website, and update the poster as necessary.
Food service establishments may display the sample poster in lieu of the poster, provided the information is presented and posted in an easily readable manner. This information must state that a reaction to a food allergen is potentially life-threatening, and include information regarding the risk of an allergic reaction, the major food allergens, the proper methods and procedures for checking ingredients in food items, the importance of clear communications between customers and staff, and methods for preventing cross-contact.
HB 464 does not create a private cause of action or change any common law or statutory duty.
HB 464 would violate the principles of limited government, free market, and individual liberty by involving government in another mandate that is beyond the proper function of state government. Texas Action opposes HB 464.
