Relating to the possession, carrying, or transportation of a
firearm or alcoholic beverage by certain persons during the use of
an easement.
No significant fiscal implication to the State is anticipated.
HB 4346 would require that an instrument granting an access easement or
appurtenant easement not restrict or prohibit an easement
holder or holder's guest from having a firearm or alcoholic beverage while using the easement. Additionally, the bill would require the owner of a servient estate not enforce a
restrictive covenant in an instrument granting an easement on the
servient estate that restricts or prohibits the easement holder or
the easement holder’s guest from possessing, carrying, or
transporting a firearm or alcoholic beverage while using the easement for the easement’s
purpose.
Texas Action supports HB 4346 which upholds individual liberty and property rights of landlocked property owners to access their property without having to give up their second amendment or other lawful rights in the process.
