Bill Analysis

HB 4346 would require that an instrument granting an access easement or appurtenant easement not restrict or prohibit an easement holder or holder's guest from having a firearm while using the easement for the easement’s purpose. Additionally, the bill would require the owner of a servient estate not enforce a restrictive covenant in an instrument granting an easement on the servient estate that restricts or prohibits the easement holder or the easement holder’s guest from possessing, carrying, or transporting a firearm while using the easement for the easement’s purpose.

Vote Recommendation Notes

Texas Action supports HB 4346 which upholds individual liberty and property rights of landlocked property owners to access their property without having to give up their second amendment rights in the process.
