Relating to the enforcement of insurance laws, including laws governing the unauthorized business of insurance; authorizing administrative penalties.
The amounts and timing of any new penalty revenue are unknown; therefore, the fiscal impact on the State cannot be determined.
HB 4313 would modify existing law to ensure that the Texas Department of Insurance (TDI) has the tools it needs to enforce Insurance Code relating to unauthorized insurance. This would include authorizing the department to administer fees to violators of existing law.
Without necessarily endorsing all of the insurance statutes this bill would affect, we do recognize that TDI needs to be able to effectively perform its duties. HB 4313 does not appear to conflict with our liberty principles and we remain neutral.
