Relating to the authority of certain municipalities to impose
regulations on amplified sound from certain venues.
No fiscal implication to the State is anticipated.
HB 3813 would prohibit certain municipalities from enforcing an ordinance that regulates amplified sound from a bar as long as the sound is under 85 decibels and is between the hours of 10 am and 2 am.
Noise ordinances are generally considered within the legitimate purview of local government so long as they are applied evenly without making special carveouts for preferred entities. While state intervention in local affairs is sometimes necessary to prevent overregulation by local governments, this does not appear be such a case. Texas Action is opposed to HB 3813 on the principle of limited government.
