Relating to liability arising from farm animals.
No significant fiscal implication to the State is anticipated.
HB 365 would expand the liability protections provided under the Texas Farm Animal Liability Act (FALA). Current law protects eligible individuals from liability for injuries or death related to certain activities and events involving farm animals. HB 365 would expand FALA protection to include farm owners and lessees, as well as expand definitions to cover more types of animal related activities such as branding, weening, transporting, producing, corralling, herding, vaccinating, and a number of other customary farm activities.
HB 365 was amended on the floor of the House to make minor definition changes. This amendment does not affect our vote recommendation.
Texas Action supports HB 365 which uplifts our Individual Liberty, Private Property Rights, and Limited Government principles by protecting farmers, ranchers, and their employees from frivolous liability claims arising from normal farm and ranch work.
