Bill Analysis

HB 359 would modify existing law regarding settlement claims during motor vehicle accidents with uninsured or underinsured drivers by allowing an insured driver to begin recovery action without a judgement or other legal determination establishing the other motorist's liability or the extent of the insured's damages as a prerequisite.

The bill would also allow an insured to provide notice of a claim for uninsured or underinsured motorist coverage by providing a written notification to the insurer that reasonably informs the insurer of the facts of the claim.   

Vote Recommendation Notes

While HB 359 does have a significant impact on the claims process related to uninsured/underinsured motorists, the changes proposed by this bill do not appear to have a connection to our liberty principles. Texas Action remains neutral on HB 359.
