Bill Analysis

HB 3367 would modify existing law regarding certain HOAs in a variety of ways such as enacting restrictions on who can serve on an architectural control committee, requiring HOAs to file management certificates with the the Texas Real Estate Commission to create a database of HOAs and removing an HOA's lien authority if it failed to file a management certificate.

Vote Recommendation Notes

Texas Action opposes HB 3367 because it violates our limited government principle. HOAs are voluntary membership-based associations. The terms of membership and the rules of the association are a matter of private contract between willing parties which the state should avoid interfering with.
