Relating to prohibiting discrimination against living organ donors by certain insurers.

Bill Analysis

HB 317 would prohibit an insurer from rejecting, denying, limiting, canceling, refusing to renew, increasing the premiums for, or otherwise adversely affecting the individual’s eligibility for, cost of, or coverage under a life insurance policy or contract, disability insurance policy, or long-term care insurance policy offered by the insurer on the sole basis that the individual is a living organ donor.

This bill would also prohibit an insurer from preventing an insured from donating all or part of an organ as a condition of the aforementioned insurance policies and contracts.

Vote Recommendation Notes

Texas Action opposes HB 317 because it violates the principles of limited government and free markets. When the government mandates that insurers cover higher-risk individuals, it forces insurers to increase rates for everyone else in order to subsidize these mandates. This is not an appropriate function of government.
