Relating to the purchasing of the uniform of certain honorably retired or medically discharged peace officers.

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 315 would permit an honorably retired peace officer to purchase a uniform that was formerly commissioned to them by a state agency. If enacted, the state agency would be responsible for setting an amount not to exceed the fair market value of the uniform. HB 315 would also permit such an officer to be buried in a uniform they purchase.

HB 315 was substituted in a Senate committee. The committee substitute would permit medically discharged officers and the nearest surviving relative of an eligible deceased officer to purchase their uniform. These changes do not affect our vote recommendation.

Vote Recommendation Notes

Texas Action supports HB 315 because it would advance individual liberty. A former state police officer should be free to obtain and be buried in the uniform they served in. HB 315 would ensure that they have that freedom while also ensuring that the set price is reasonable.
