Relating to the enforcement of certain federal laws regulating firearms, firearm accessories, and firearm ammunition within the State of Texas.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 2622 would prohibit any Texas agency or employee of an agency, employees of political subdivisions, and law enforcement officers from contracting with or in any other manner providing assistance to a federal agency which imposes a prohibition, restriction, or other regulation of a firearm or ammunition that does not exist under current state law.

Additionally, political subdivisions would not be able to receive state funds if they enter into a contract or adopt a rule, order, ordinance, or policy requiring the enforcement of any federal statute, order, rule, or regulation or requires or assists with the enforcement of any federal statute, order, rule, or regulation described by this legislation. The bill would also provide a process by which a person living within a political subdivision in violation of the bill may file a suit to be reviewed by the attorney general.

Vote Recommendation Notes

Texas Action supports HB 2622 on the principles of limited government, individual liberty, and free market. Allowing contracts and assistance between the state and federal agencies which discriminate against firearm owners infringes on individuals' rights to keep and bear arms.
