No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 2315 would make any property used in the commission of a Class A misdemeanor or felony racing on a highway offense eligible for civil asset forfeiture, except for a racing on highway offense that is a Class A misdemeanor based on the person possessing an open container.

Vote Recommendation Notes

While we support the goal of reducing illegal street racing, we oppose increasing civil asset forfeiture which is inconsistent with limited government and property rights. We oppose HB 2315 unless amended to make forfeiture of property used in the commission of a street racing offense contingent on conviction for the offense.
