Relating to the automatic transfer of manufacturer's warranties on air conditioning systems conveyed with residential real property.
No fiscal implication to the State is anticipated.
HB 2110 would mandate that manufacturer's warranties for air conditioning systems on a residential property must be transferred to a new owner if an air conditioning system is conveyed as a fixture of the property to the new owner. The bill specifies that a warranty transferred under this bill would continue as if the new owner was the original owner and the warranty would not be extended by a warranty transfer as laid out in this bill. The bill also prevents the warrantor from charging a fee for the transfer of the warranty.
Texas Action opposes HB 2110 because it violates the limited government and free-market principles. While this would certainly constitute a good business practice, the government should not make it mandatory.
