Relating to the prohibition of housing discrimination on the basis
of sexual orientation or gender identity or expression and to the
enforcement of that prohibition.
No significant fiscal implication to the State is anticipated.
HB 191 would prevent private property owners from choosing to rent or sell residential properties to individuals who do not identify with their gender based upon science. The bill would also create new protected classes people based on their sexual orientation, or gender identity or expression.
Texas Action opposes HB 191 on the principle of limited government. The mandates proposed by this bill, and creation of new protected classes of people, is beyond the proper role of government.
Among other practical problems with HB 191, the bill would prohibit homeless shelters from serving exclusively male or female individuals, potentially endangering them by allowing dubious characters to falsely identify as another gender in order to gain access to them.
