Relating to the contractual relationship between a pharmacist or pharmacy and a health benefit plan issuer or pharmacy benefit manager.
No significant fiscal implication to the State is anticipated.
HB 1763 would institute several health care reforms such as establishing price transparency measures, prohibiting claim payment discrimination between affiliated and non-affiliated pharmacies, and prohibiting contracts with pharmacists from demanding that the pharmacist in question have higher certification that federal or state requirements.
This legislation is an attempt to fix some of the unintended consequences of government intervention in the healthcare and health insurance industries. We would prefer fixing those problems by getting government out of those industries and allowing the market to operate freely. We recognize that is not entirely up to the state of Texas because of significant federal intervention in those areas. Texas Action is neutral on HB 1763.
