Relating to the construction of certain assisted living facilities located within a floodplain in certain counties and to a seller's disclosure of the location of certain real property within a floodplain. 

Fiscal Notes

No significant fiscal implication to the State is anticipated. 

Bill Analysis

HB 1681 would prohibit the construction of an assisted living facility within a 100-year floodplain if the facility is located in a county with a population of 3.3 million or more; this would not apply to the expansions or renovations of existing assisted living facilities. 

HB 1681 would also require a seller of a tract of real property less than 15 acres without a residence existing on or being constructed on the property, to provide a notice at the time of sale disclosing whether any part of the property is located in a 100-year floodplain. If this notice is not provided and a flood occurs before the fifth anniversary of the date of purchase, the purchaser would be entitled to recover damages. 

Vote Recommendation Notes

Texas Action opposes HB 1681 which is inconsistent with the principles of limited government, free markets, individual liberty, and private property rights.
