HB 1475 would mandate the specific factors a municipal board of adjustment may consider when determining appeals made to zoning variances due to hardships.

Vote Recommendation Notes

Texas Action opposes HB 1475 which is out of alignment with our limited government principle. Current statute does not limit what factors a board of adjustment may consider when determining an appeal. This bill would limit the factors that may be considered to only those enumerated in the bill, thus diminishing a board's ability to consider other factors.
