Bill Caption

Relating to the creation of the criminal offense of impersonating a private investigator.

Fiscal Notes

No significant fiscal implication to the State is anticipated

Bill Analysis

HB 1400 would create a Class A misdemeanor offense for the impersonation of a private investigator. A person would commit the offense if the person impersonates a private investigator with the intent to induce another to submit to the person’s pretended authority or to rely on the person’s pretended acts of a private investigator; or to knowingly purport to exercise any function that requires licensure as a private investigator.

Vote Recommendation Notes

Texas Action opposes HB 1400 which would grow government by creating a new criminal offense with a punishment that does not fit the crime. At most this should be a civil offense punishable by fine.
