Relating to the limitation period for filing a complaint and
requesting a special education impartial due process hearing.
No significant fiscal implication to the State is anticipated.
HB 1252 would prohibit the commissioner of education or Texas Education Agency from establishing a limitation period for filing a due process complaint alleging a violation of
state or federal special education laws that is shorter than the period established under federal law which is currently two years.
Texas Action is neutral toward HB 1252.
