Relating to the requirement for a deputy sheriff, reserve deputy sheriff, deputy constable, or reserve deputy constable to take an official oath.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 1049 would permit a person that was reappointed as a deputy sheriff or constable to perform the duties of the office before retaking the required oath. Such a person would be required to retake the oath as soon as possible.

Vote Recommendation Notes

Texas Action is neutral on HB 1049 as it does not touch directly upon any of our Liberty Principles. This bill would accommodate an administrative need for relevant law enforcement agencies without infringing on the rights of individuals.
