Expressing opposition to the enactment or enforcement in Texas of a law that automatically suspends the driver's license of an individual who is convicted of any drug-related offense.
SCR 10 would support the Governor submitting a written certification to the U.S. Secretary of Transportation stating the Governor's opposition to enforcement of a federal law which requires a mandatory license suspension period after the conviction of any drug related offense. This would result in a loss of 10% of the funds to be apportioned to the state under law governing aid for highways.
Texas Action supports SCR 10 for promoting the principles of individual liberty and limited government. Automatic suspension of a driver's license is not always proportional to the crime, and may jeopardize employment and ability to repay court costs and fines. This bill would help mitigate this harsh and unnecessary punishment.
