Relating to the release by a peace officer of certain individuals suspected of the offense of public intoxication.
No significant fiscal implication to the State is anticipated.
SB 306 would allow police officers to release individuals who have been detained for public intoxication if they consent to voluntary treatment for substance abuse at a facility approved by the Health and Human Services Commission, or verbally consent to voluntary admission to a facility that provides a safe place for individuals to become sober under supervision.
Texas Action supports SB 306 because it supports the principles of limited government and individual liberty by providing additional alternative options for police officers instead of arresting and booking a person who has been detained for public intoxication. This will save time, resources, and money on behalf of taxpayers, and save individuals who are detained for public intoxication some time, embarrassment, and expense. For these reasons we support SB 306.
