Bill Analysis

SB 2409 would prohibit as a deceptive trade practice the act of intentionally using a web domain name similar to a legitimate ticket sales vendor for certain event tickets. The bill would limit the use of the domain name to the venue itself, creating a cause of action if found to be intentionally violated. The purpose of this bill is to prevent ticket sellers from using deceptively similar domain names to trick consumers into purchasing event tickets at inflated prices. 

Vote Recommendation Notes

Texas Action remains cautiously neutral on SB 2409, as it does not appear to affect any of our liberty principles. While we are always cautious about infringement of free speech under the guise of consumer protection, this bill does appear to fall within the scope of the Deceptive Trade Practices Act which we have supported in the past.
