Relating to the authority of the Health and Human Services Commission to obtain criminal history record information.
No fiscal implication to the State is anticipated.
SB 2200 would clarify that the Health and Human Services Commission will continue to be able to obtain criminal history record information. This codification of current policy would comply with federal law which requires explicit statutory authority to a specific state agency to allow that agency access to an individual's background or criminal history record information.
Since this is a matter that does not concern liberty principles, Texas Action has a neutral stance towards SB 2200.
