Bill Caption

Relating to the administration, implementation, and enforcement of federal produce safety standards by the Department of Agriculture.

Fiscal Notes

According to the Legislative Budget Board, no fiscal impact to the state is anticipated.

Bill Analysis

SB 1409 would prohibit the Texas Department of Agriculture from imposing "additional or more burdensome requirements" than the U.S. Food and Drug Administration (FDA) has imposed for the safety of produce. The bill specifies that rules made may not exceed regulations already adopted by the FDA.

Vote Recommendation Notes

Texas Action supports SB 1409 because it promotes limited government, free markets, and individual liberty. The agriculture industry is already highly regulated, and this bill would prevent additional and more burdensome requirements by the state.
