SB 1217 would prohibit state licensing boards from considering an arrest that did not result in a criminal conviction or deferred adjudication community supervision during the licensing certification process for an individual who is seeking a professional license in a field.
According to the author, this bill is an attempt to reduce the amount of false arrests that are taken into consideration during professional licensing approvals.
Texas Action recommends supporting SB 1217 as it uplifts our principles of limited government, individual liberty, personal responsibility. We are in favor of eliminating state licensure requirements for certain professions and reducing barriers of entry to industries. For these reasons, we support SB 1217.
