Relating to the applicability of certain electric energy storage equipment requirements to municipally owned utilities and electric cooperatives.

SB 1012 would clarify that a municipally-owned utility or an electric cooperative that owns or operates electric energy storage equipment or facilities are not required to register as a power generation company with the Public Utilities Commission. According to the author's statement of intent the purpose of this bill is to "reaffirm PUC policy that municipally owned utilities and co-ops may own and operate batteries without having to register as a power generation company with PUC."
Texas Action remains neutral on SB 1012 because it does not affect our liberty principles.
