The Legislative Budget board does not anticipate any significant fiscal impact to the state. 

Bill Analysis

SB 1010 would prohibit a district that overlies a common aquifer with another district from making or enforcing a rule unless it is similar to a rule made or enforced by the other district or districts that overlie the aquifer. The district would be able to make or enforce a rule that is not similar to another district's rule only if it is authorized by law or provides in the district’s management plan an explanation of the reasoning.

Vote Recommendation Notes

SB 1010 would support private property rights and limited government by reducing regulatory overreach that infringes on the rights of landowners. Groundwater conservation district rules should be as light as possible, transparent, and easy for landowners to navigate and understand. Districts overlying a common aquifer should have substantially similar rules with few exceptions. We support SB 1010.
