Relating to the criminal consequences of engaging in certain conduct with respect to certain instruments designed, made, or adapted for use in striking a person with a fist.

Fiscal Notes

The Legislative Budget Board does not anticipate any significant fiscal impact to the state. 

Bill Analysis

HB 446 repeals Section 46.01(8) of the Penal Code, by striking "knuckles" from the list of weapons that are illegal to posses. In doing so, it would also remove the penalty for possessing this device.

Vote Recommendation Notes

This bill supports property rights, individual liberty, and limited government by abolishing the prohibition on owning knuckles which are an inexpensive self defense tool. The bill also does away with the associated Class A Misdemeanor which is disproportional to the crime of possessing brass knuckles. For these reasons we support HB 446.
