HB 435 would allow a clerk of court the ability to make a recording decision in certain cases where fees have been deemed noncollectable. The clerk of a court would be allowed to document the uncollected fee by attaching it to the case file. In addition, HB 435 amends the time that is required to pass for the collection from 20 years to 15 years. The bill would repeal a section in the Code of Criminal Procedure where this action is only applicable to certain counties, authorizing all counties to alter their procedures relating to uncollected court costs.
