Relating to the creation of tenant legal services offices by local
governments to assist low-income residential tenants in eviction cases and in cases
involving discrimination based on the tenants’ disabilities
No fiscal implication to the State is anticipated.
HB 4125 would allow local governments to create tenant legal services offices to provide legal representation for low-income Texans facing eviction. The majority of the bill lays out the procedures for the offices, including the requirement of an annual report to be submitted by the office to the local governing body.
Texas Action opposes HB 4125 for violating the principles of personal responsibility, limited government and free markets. It is not the proper role of government to provide attorneys for these purposes at taxpayer expense.
