Fiscal Notes

There would be an indeterminate fiscal impact to the state. The number of permit holders that would voluntarily join the financial assurance program established under provisions of the bill, and the amount of funds that would be deposited and held by the Texas Commission on Environmental Quality, is unknown. 

Bill Analysis

HB 4116 would require the Texas Commission on Environmental Quality (TCEQ) to create a program to allow a permit holder for the discharge of effluent (liquid waste or water) into any body of water under the National Pollutant Discharge Elimination System to deposit with TCEQ an amount of money, or evidence of equivalent financial assurance to be held by TCEQ, to be used in the event the permit holder causes a discharge that violates the terms of an agreement under the program.
