Bill Analysis

In the trial of certain offenses, if the court determines that the offense involved family violence, the court is required to make an affirmative finding of that fact and enter the affirmative finding in the judgment of the case.

HB 3824 would include the following offenses among offenses for which a court is required to make an affirmative finding regarding the involvement of family violence: (1) violation of certain court orders or conditions of bond in a family violence, child abuse or neglect, sexual assault or abuse, stalking, or trafficking case; (2) violation of a protective order preventing an offense caused by bias or prejudice; (3) repeated violation of certain court orders or conditions of bond in family violence, child abuse or neglect, sexual assault or abuse, stalking, or trafficking case; (4) continuous violence against the family; and (5) stalking.
