HB 2909 would make numerous changes to the Election Code, including among other things: requiring the second election, occurring after a tie vote, to be held not earlier than the 20th day or later than the 45th day after the date the automatic recount is completed; authorizing tied candidates, if the recount does not resolve the tie, to (1) cast lots not later than the day before the date the authority is required to order the second election; or (2) withdraw from the election not later than 5:00 PM of the day after the date the automatic recount is held; providing that in case of an election in which any members of the political subdivision’s governing body are elected from territorial units the subchapter relating to "Election of Unopposed Candidate" applies if each candidate is unopposed and no opposed at-large race is to appear on the ballot.
As this legislation concerns amendments and clarifications to the statutory procedure of the electoral process, Texas Action is neutral toward HB 2909.
