Relating to permit application requirements for taking sand, gravel, marl, shell, and mudshell.
No significant fiscal implication to the State is anticipated.
HB 2805 would prescribe a single application form for an individual or general permit for taking sand, gravel, marl, shell, or mudshell. Applications would be required to include publication of notice, proof that notice was sent by certified mail to certain property owners, a sedimentation impact assessment, and any amendment to the permit.
Texas Action remains neutral on HB 2805 because it does not affect our liberty principles, although the effect of this bill may be to enhance clarity and make the permit process for these activities easier for folks in the oyster industry.
