Relating to the exemption of certain commercial weighing or
measuring devices from registration and inspection requirements.
No significant fiscal implication to the State is anticipated.
Current law exempts certain weighing devices from being subject to Texas Department of Agriculture inspection and registration requirements so long as the device is exclusively used to weigh food that is sold for immediate consumption. HB 2223 clarifies that the exemption stands whether the food is consumed on the premises or not. The bill also stipulates that the exemption only applies to prepared foods that are not exempt from sales and use tax.
