Relating to providing information and other resources regarding safe disposal of Schedule II controlled substance prescription drugs.

HB 2088 would amend Section 481.074 of the Health and Safety Code, to provide information regarding safe disposal of controlled substance prescription drugs. Under the provisions of the bill, a person dispensing a controlled substance would be required to provide the person receiving the controlled substance written notice of certain information about options for the disposal of controlled substances. This notice would apply to a Schedule II Controlled Substance prescription drugs.
The author's purpose for this bill is to address the opioid crisis by providing information and education concerning Drug Take-Back programs for leftover prescription drugs to prevent them falling into the wrong hands and being misused.
Since this is a matter that does not affect our liberty principles, Texas Action has a neutral stance towards HB 2088. Pharmacy dispensers are already required to make certain disclosures when dispensing controlled substances. The addition of this written notice is not particularly onerous and does not offend our liberty principles.
