Bill Caption

Relating to the dismissal of certain actions relating to Medicaid fraud.

Fiscal Notes

The Legislative Budget Board does not anticipate any significant fiscal impact to the state. 

Bill Analysis

Under current law, a civil action related to Medicaid fraud brought by a private person may be dismissed before the end of the period in which the petition remains under seal only if the court and the attorney general consent in writing to the dismissal and state their reasons for consenting. 

HB 2004 would allow the court and attorney general to consent to a dismissal at any time, not only during the period during which the petition remains under seal. 

Vote Recommendation Notes

Texas Action supports HB 2004 as it uplifts our principles of limited government and personal responsibility. In effect, this would eliminate the perverse incentive for the filing of certain frivolous lawsuits.
