Relating to the construction manager-at-risk method of contracting
for governmental construction projects.
No significant fiscal implication to the State is anticipated.
HB 1752 would require construction managers-at-risk selected for a governmental work contract to use the competitive bidding method or competitive sealed proposal method to consider a contract with a trade contractor or subcontractor in the same way as required for a governmental entity. Additionally, if the construction manager-at-risk chooses to use the competitive sealed proposal method, the manager must use price as a selection criteria and the weighted value of price as a selection criterion must be 40 percent or more of the total weighted value of all of the selection criteria.
Texas Action remains neutral on HB 1752 as it does not affect our liberty principles.
