Fiscal Notes

The fiscal implications of the bill cannot be determined at this time. It is unknown to what degree a court inquiry would cause a person to pursue indigent status, whether or not that person would qualify for indigent status, and in what way this would impact payment of surcharges under the Driver Responsibility Program.

Bill Analysis

Under current law, if an individual commits a certain traffic offense and is compelled to join the driver responsibility program, and if they can provide evidence of their indigence, then the Department of Public Safety is required to waive all surcharges assessed under this chapter. If this bill passes, upon its own motion a court may inquire if a person would like to submit evidence of their indigent status. 

Vote Recommendation Notes

This bill is what we view as a primarily procedural bill that has no bearing on our liberty principles. For these reasons, we remain neutral on SB 779. On a related note the Driver Responsibility Program, which is a form of overcriminalization, is an abusive program which should be repealed altogether.
