Bill Analysis

Under current law, the state must submit notice to a property owner whose land the state plans to seize through eminent domain. SB 626 would require the state to include in that notice an offer to acquire, from the owner, any of their other land that the state wishes to acquire outside of condemnation. This would include a statement that the other land specified in the offer is not subject to condemnation.

Vote Recommendation Notes

This bill supports the principles of limited government and private property rights by requiring the state to make an offer for other land they wish to acquire and ensuring the owner knows that land is not subject to condemnation. For this reason, we support SB 626.
