Bill Caption

Relating to the adoption of the Uniform Partition of Heirs’ Property Act.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

Under current law, Chapter 23 of the Property Code deals with land partitioning. SB 499 would add a supplementary chapter to the Property Code specifically to deal with the uniform partitioning of the land of heirs. This would include a determination of value, provisions for cotenant buyout, alternatives to partitioning, partitioning in-kind, and open-market sale.

Vote Recommendation Notes

SB 499 neither uplifts nor offends our liberty principles, therefore we remain neutral.
