Bill Analysis

SB 40 increase the amount of bonds required to be taken out by certain judges who preside over guardianship proceedings. As an alternative to a bond, a county would be able to obtain insurance to protect against losses caused by gross negligence of a judge of a statutory county court in performing the duties of office. The purpose of this bill is to protect he assets of estates under guardianship from gross judicial negligence. 

Vote Recommendation Notes

This bill protects the property rights of estates under guardianship from being improperly tended to by a judge without recourse for the property owner. For this reason we support SB 40.
