Bill Analysis
SB 382 would amend the Health and Safety Code
to allow an individual to donate unused prescription drugs to a participating
health care provider for dispensation The executive commissioner of the Health
and Human Services Commission would adopt standards and procedures for the
accepting, inspecting, and dispensing of drugs. A provider would be authorized
to charge a fee of up to $20 to cover the costs of inspecting, storing,
labeling, and dispensing the donated prescription drug.
Vote Recommendation Notes
This bill enhances our limited government principle by allowing a donation program for unused prescription drugs to be donated and redistributed - something which the law does not currently allow. We support SB 382.
