Relating to the plugging or capping of abandoned, deteriorated, open, or uncovered water wells in the Bandera County River Authority and Groundwater District.

Bill Analysis

SB 2068 would allow a district to enter into a contract with a licensed water well driller to cap an open, uncovered, or abandoned well, or permanently plug a deteriorated well. A district employee would also be able to carry out these tasks if they have received the necessary training.

The district would be allowed to require the owner or lessee of the land on which a well is located to keep the well permanently closed or capped; use any money available to pay for expenses incurred; and enforce this section against any person by injunction, mandatory injunction, or other appropriate remedy in court.
