Bill Analysis

SB 1559 would amend the Estates Code to prohibit a county clerk from charging or collecting from the estate of a proposed ward or ward a fee for the filing of a guardianship proceeding and a fee for any service rendered by the court if the court finds that the proposed ward or ward became incapacitated as a result of a personal injury sustained while in active service as a member of the U.S. armed forces or in the line of duty as a public officer or employee. 

Vote Recommendation Notes

Though well intended, providing exemptions for one group over another is a violation of our limited government principle. Due to this fundamental violation, we oppose this bill and all such exemptions.
