Bill Analysis

SB 1446 would amend the Government Code to make a series of changes to contested cases conducted under the Administrative Procedures Act. The first to take of note of is that a notice of hearing in a contested case must include a statement of the factual matters asserted or an attachment that incorporates by reference the factual matters asserted in the complaint or petition filed with the state agency. Also, a state agency must notify each party to a contested case of any decision though personal service, email, first class mail, or a method specified in the agency’s rules.
