Proposing a constitutional amendment to restrict the power of the legislature to mandate requirements on a municipality or county. 


Fiscal Notes

Depending upon future actions of the legislature, there could be an indeterminate cost to the state to pay or reimburse municipalities and counties.

The cost to the state for publication of the resolution is $114,369.

Bill Analysis

This proposed constitutional amendment would prohibit the legislature from requiring a county or municipality to expand or establish activities that require an additional expenditure of revenue. Before imposing mandates on counties and municipalities the legislature must establish a revenue source for the payment or reimbursement for the costs of complying with the mandate.

If HJR 73 passes, this joint resolution will be submitted to the voters at an election to be held November 7, 2017.

Vote Recommendation Notes

This amendment would promote limited government by prohibiting the state legislature from imposing unfunded mandates on counties and municipalities. For this reason we support HJR 73.
